How does it work?
A solution that both parties can accept is often reached when a neutral third party helps each of the involved parties to communicate the issues in a nonconfrontational or judgmental way. The mediator acts as that neutral third party and leads disputants to reach their own voluntary solution through gaining understanding of each other’s issues. The mediator makes sure everyone fully understands the issues. When each person feels safe and that they have been heard, an issue is often solved.
Mediation cases are private and often informal. Most likely that can be solved without legal judgement by a judge or jury. An example are claims involving a dispute against a neighbor---a tree blocking a view, a security light that shines too brightly into another neighbor’s window. No one really wants to go to court over these issues. Mediation can help you avoid court and keep a good neighbor as well.
Mediation is also used in landlord tenant disputes. A tenant may feel the landlord has slacked off on making repairs to the property---leaky faucets, plugged drains, peeling paint. Landlords may feel the tenant is not keeping their end of the bargain---neighbor complaints over noise, parties, general upkeep on the property. A mediator will listen and help both parties clarify their thoughts, feelings, and choices, often leading to a better landlord-tenant relationship.
Mediation is known to work efficiently in most non-criminal matters and claims that do not involve a legal issue. Even some non-violent criminal cases of verbal harassment have used mediation if there is no threat of physical harm involved.
